Brake Lights Stay On

I have a 2012 Compass 2.4L 4x4 -

When I turn on my headlights my tail lights come on, and when I press the brake pedal the brake lights come on. All normal right, but when i take my foot off the brakes the brake lights stay on. The 3rd brake light goes off though. Then I turn my headlights off and on again and they go back to regular tail lights until I hit the brakes again. Sometimes this problem doesn't happen, seems to be different every time I start the car, also my brake lights work normally when my headlights are turned off.

Any ideas what it might be?

Check the brake light switch and look for the rubber and see what the condition of it is. Also make sure your handbrake is all the way done.

Thanks for the reply, the only reason that I didn't think it was the switch was because the brake lights work when the headlights are turned off and also because the 3rd brake light goes out like normal. I will check it either way to make sure it isn't sticking. I have a manual transmission so the handbrake is down for sure.
